On December 14, 2018, the Coalition and National Parks Conservation Association (NPCA) jointly filed an amici curiae brief with the U.S. Court of Appeals for the Fourth Circuit in Richmond, VA in support of a lawsuit filed by the Sierra Club and the Virginia Wilderness Committee (Plaintiffs) against the National Park Service (NPS). Plaintiffs allege that the NPS violated a number of environmental laws and regulations, including the NPS Organic Act and the Blue Ridge Parkway’s enabling legislation, in approving a permit for the Atlantic Coast Pipeline to be constructed by Dominion Energy across the Appalachian Trail and the Parkway in west/central Virginia. Plaintiffs also claim that NPS failed to conduct adequate environmental compliance under the National Environmental Policy Act (NEPA) when it approved the permit under a categorical exclusion.
