Dear Secretary Bernhardt,

On behalf of our over 1,800 members, the Coalition to Protect America’s National Parks (Coalition), urges you to halt all oil and gas lease sales as our country continues to navigate the significant impacts of COVID-19 pandemic. As a group we collectively represent over 40,000 years of experience managing and protecting America’s most precious and important natural and cultural resources. Among our members are former NPS directors, regional directors, superintendents, resource specialists, rangers, maintenance and administrative staff, and a full array of other former employees, volunteers, and supporters.

The oil and gas industry is experiencing a historic decline as demand has plummeted because of the pandemic. Continuing to lease public lands in this environment not only prevents taxpayers from getting fair market value, but it also hinders efforts to manage those lands for other values that benefit the American people and local communities, including outdoor recreation, wildlife conservation, and cultural resources preservation. In addition, restrictions on public gatherings and face-to-face interactions, while necessary for health and human safety, impair the ability of the general public, issue experts, and others to weigh in on federal government actions that affect them, including those resulting from oil and gas lease sales. Based on our substantial collective experience engaging with the public on issues related to the protection and preservation of our parks and public lands , we feel strongly that there is no way to ensure adequate public engagement in important federal agency actions such as proposed oil and gas leasing, at this time.

After dismal returns on federal oil and gas lease sales in the first quarter of this year – when nearly half of all public lands offered for leasing (128,500 acres) went unsold – your department wisely suspended all planned lease sales for the second quarter, following the lead of states such as Utah and Colorado. Unfortunately, there are still over 470,000 acres slated for oil and gas lease sales in quarter three, despite the fact the conditions on the ground and in the market have not meaningfully changed since this spring.

Of added concern, the basic framework for federal oil and gas leasing was established decades ago and is consistently leading to leasing proposals and decisions that threaten the protection of our national parks and the quality of the visitor experience

An upcoming lease sale within 10 miles of Carlsbad Caverns National Park in New Mexico will not only jeopardize critical species habitat, it will endanger the irreplaceable natural and cultural resources at the park. Caves have a fragile ecosystem. Oil and gas drilling on nearby lands could leak gas or fluids into the cave’s passages, destroying the delicate balance that exists within the walls of the cave. In addition, oil and gas development could compromise the dark skies and scenic beauty that draws so many visitors to New Mexico.

In Utah, an upcoming sale near Moab will threaten habitat for elk, mule deer and pronghorns. And while national parks such as Arches and Canyonlands have been spared this time around, this sale will impact the Old Spanish National Historic Trail. Several parcels that will be part of the sale lie near the trail and could impact the visitor experience. Any development near the trail will impair the ability of the visitor to truly “step back in time” and share the experience of this historic route with those who traveled it generations ago.

There are several pieces of legislation awaiting action in Congress that would take crucial steps towards bringing the woefully outdated leasing program into the 21st century. Specifically, the bipartisan Fair Return for Public Lands Act (S. 3330) would update the federal onshore fiscal rates and help ensure that taxpayers receive their fair share for the use of public lands. The End Speculative Oil and Gas Leasing Act of 2020 (S. 3202) would end the practice of leasing low and no potential lands for oil and gas drilling by requiring the Bureau of Land Management to assess all lands’ mineral development potential before offering those lands for lease, and prohibiting leasing on any lands found to have low or no development potential. Lastly, the Leasing Market Efficiency Act (S. 4223) would end the practice of selling oil and gas leases without a competitive bid.

The Coalition supports each of these proposals and urges you to work with Congress to fix our broken oil and gas leasing system. We further recommend that you halt lease sales immediately and indefinitely until the pandemic subsides and Americans can fully engage in federal decision-making processes again. It is time to start putting American taxpayers, public lands, and local communities first.
