11th Circuit Confirms NPS Conservation Mandate Applies at Big Cypress National Preserve

Based on deference to agency discretion, a recent U.S. Court of Appeals decision sided with the NPS in a lawsuit filed by conservation groups over the controversial 2011 general management plan for the Preserve’s Addition lands. Despite the affirmation of the NPS plan, the court also held that the NPS Organic Act’s “conservation mandate” applies at all units of the National Park System, in stark contrast to the “multiple use mandate” that had been described for the Preserve in a lower court ruling.
